2. Acceptance of Terms
By accessing our website or engaging our services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you should not use our website or engage our services. You must be at least 18 years of age to use our website or engage our services. By using our website or engaging our services, you represent that you have the legal capacity to enter into this agreement.
3. Description of Services
Silverthorne provides inheritance law services in Malaysia, including Syariah Court representation for estate distribution matters, preparation of Lasting Power of Attorney documents, and annual estate plan reviews. Our services are available to individuals and families located in Malaysia. Specific service details, fees, and timelines are outlined during the engagement process and confirmed in a written engagement letter.
4. Engagement Process
Submitting an enquiry through our website or contacting us by phone or email does not create a lawyer-client relationship. A formal engagement begins only when both parties sign a written engagement letter that outlines the scope of work, applicable fees, and expected timeline. Until that point, any information exchanged is for preliminary assessment purposes only.
5. User Responsibilities
When using our website, you agree to provide accurate information, use the website only for lawful purposes, not attempt to interfere with the website's functionality, and respect the intellectual property rights of Silverthorne and third parties. When engaging our services, you agree to provide complete and truthful information relevant to your matter, respond to our communications in a timely manner, and inform us of any changes in your circumstances that may affect your case.
6. Intellectual Property
All content on our website, including text, graphics, logos, and layout, is the property of Silverthorne or its licensors and is protected under Malaysian intellectual property law. You may view and download content for personal, non-commercial use only. You may not reproduce, distribute, or create derivative works from our website content without our written permission.
7. Fees and Payment
Our service fees are published on our website and confirmed in individual engagement letters. Fees are quoted in Malaysian Ringgit (RM). Payment terms and methods are specified in the engagement letter. Court filing fees, government charges, and disbursements are separate from our professional fees and will be communicated before they are incurred. We reserve the right to update our published fees at any time, though any fee changes will not affect existing engagements unless agreed in writing.
8. Service-Specific Terms
Syariah Court Representation: Our role is to prepare submissions, attend hearings, and advocate on your behalf. Court outcomes are determined by the Syariah Court and are beyond our control. Timelines depend on court scheduling and case complexity.
Lasting Power of Attorney: We draft the LPA document and guide you through registration. The effectiveness of the instrument depends on compliance with the applicable legal framework and proper execution.
Annual Estate Plan Review: We examine existing documents and provide written observations and recommendations. Implementation of any recommended changes is a separate engagement.
9. Disclaimers
Our website content is provided for general information purposes and does not constitute legal advice. While we strive to keep information current and accurate, we do not warrant that the website will be uninterrupted, error-free, or free from harmful components. Legal outcomes vary depending on individual circumstances, court decisions, and applicable law. We do not promise or imply any particular result from our services.
10. Limitation of Liability
To the fullest extent permitted by Malaysian law, Silverthorne shall not be liable for any indirect, incidental, or consequential damages arising from the use of our website or services. Our total liability for any claim related to our services shall not exceed the amount of fees paid by you for the specific service giving rise to the claim. Nothing in these terms excludes liability for fraud, wilful misconduct, or any liability that cannot be excluded by law.
11. Indemnification
You agree to indemnify and hold Silverthorne harmless from any claims, losses, or damages (including legal fees) arising from your breach of these terms, your misuse of our website, or any inaccurate information you provide in connection with our services.
12. Termination
Either party may terminate a service engagement by providing written notice, subject to the terms of the engagement letter. Upon termination, you remain responsible for fees incurred up to the date of termination. We will return any documents belonging to you and provide a summary of work completed. Provisions relating to intellectual property, limitation of liability, and indemnification survive termination.
13. Governing Law and Dispute Resolution
These Terms and Conditions are governed by and construed in accordance with the laws of Malaysia. Any disputes arising from these terms or our services shall first be addressed through good-faith discussion between the parties. If a dispute cannot be resolved informally, it shall be submitted to the jurisdiction of the courts of Malaysia, with venue in Selangor.
14. General Provisions
Entire agreement: These terms, together with our Privacy Policy, Cookie Policy, and any engagement letter, constitute the entire agreement between you and Silverthorne.
Severability: If any provision of these terms is found to be invalid or unenforceable, the remaining provisions shall continue in full effect.
Waiver: Our failure to enforce any provision of these terms does not constitute a waiver of that provision.
Assignment: You may not assign your rights under these terms without our written consent.
15. Changes to These Terms
We may revise these Terms and Conditions from time to time. Changes will be posted on this page with an updated effective date. Your continued use of our website or services after changes are posted constitutes acceptance of the revised terms.
